4. Supply of Copies to other libraries

4.1 Notwithstanding the provisions of Clauses 3.1 and 3.3, it is understood and agreed that neither the Customer nor Authorized Users may provide, by electronic means, to a user at another institution a copy of any part of SimplyMap Canada for research or private study or otherwise.

3.2.5 Incorporate parts of SimplyMap Canada in course packs, study packs, resource lists and in any other material (including but not limited to multi-media works) to be used in the course of instruction and/or in virtual and managed environments (including but not limited to virtual learning environments, managed learning environments, virtual research environments and library environments) hosted on a Secure Network (accessible only to Authorized Users by Secure Authentication). Each item shall carry appropriate acknowledgement of the source, listing title and copyright owner. Course packs in nonelectronic non-print perceptible format, such as Braille, may also be offered to Authorized Users. 2. Agreement

2.2 This License shall commence at the beginning of the Subscription Period, for each of the Licensed Materials as set out in the order form and shall automatically renew at the end of the Subscription Period, unless the Customer provides Geographic Research written notice of its intention not to renew at least 30 days prior to the renewal date. If written notice has been received by Geographic Research, the License will terminate at the end of the Subscription Period.

2. Agreement

2.1 Geographic Research agrees to grant to the Customer, for the agreed fee and limited to the number of concurrent users listed on the order form, a non-exclusive and non-transferable right to give Authorized Users access to SimplyMap Canada via a Secure Network, for the purposes of education, research, distance learning, teaching and private study, subject to the terms and conditions of this License and consistent with the fair dealing doctrine and exceptions for educational institutions and libraries in Canadian copyright law.

Scholarly Use

3.2.6 Authorized Users may transmit to a third party colleague in hard copy or equivalent electronic form only (e.g. PDF file), reasonable amounts of the Licensed Materials for personal use or scholarly, educational, or scientific research or professional use but in no case for re-sale or commercial purposes. In addition, Authorized Users have the right to use, with appropriate credit, figures, tables and excerpts from the Licensed Materials in Authorized User's own scientific, scholarly and educational works.

3.2.7 If the Licensed Materials are a database, compilation or collection of information, Authorized Users shall be permitted to extract or use information contained therein for purposes such as educational, scientific, or research purposes, including extraction and manipulation of information for the purposes of illustration, explanation, example, comment criticism, teaching, research or analysis.
